High court orders RSMSSB to quash junior instructor exam notification

RSMSSB, Rajasthan high courtThe Rajasthan High Court, on 17 January, directed the State government and Rajasthan Subordinate & Ministerial Services Selection Board (RSMSSB) to quash the currently notified Junior Instructor recruitment process and issue a fresh notification for the same. RSMSSB was going to organise the written exam on 22nd January.

RSMSSB had issued an advertisement (no. 06/2016) on 16 September 2016 for filling 402 posts of Junior Instructor under Department of Skills, Planning, and Entrepreneurship (Technical Education). The trades included Computer Operator & Programming Assistant; Mechanic Diesel Engine; Electrician; Fitter; Mechanic Refrigeration & Air Conditioner and others.

The D.B. Civil Writ Petition No. 12145/2016 was filed in the Rajasthan High Court, Jodhpur wherein the petitioners challenged the validity of the advertisement issued by RSMSSB. The petitioners said the advertisement violates the prescribed standards for Junior Instructors eligibility as framed by the National Council for Vocational Training (NCVT). The petition mentioned that the qualification of Craft Instructor Training Scheme (CITS) has been made mandatory for ITI Instructors by the DGT, but the same was not included in the advertisement issued by RSMSSB. The petitioners appealed that the candidates lacking necessary qualification of CITS, being ineligible, cannot be inducted. Additionally, 30 weightage marks are provided to CITS qualified candidates, but as RSMSSB has not included the qualification criteria, the eligible candidates are deprived of the same, the court was informed.

After hearing both the parties, the High Court bench headed by Justice G.R. Moolchandani and Justice Govind Mathur said the writ petition challenging the recruitment process is allowed and the advertisement is consequently quashed. The bench further observed that the State government is directed to issue a fresh advertisement as per the NCVT guidelines.

Earlier, the online applications were submitted from 21 September to 22 October and on 20 December, the Board announced that the examination will be held on 22 January. Even the admit cards were issued to all the applicants, however, as the examination now stands cancelled, the Board has asked the candidates to keep a regular tab on its official website for further notifications.
